It affects queries using subsequence() with two more conditions:
1.) some items at the start are skipped and
2.) the result of subsequence is used as input for other expressions.

I think the problem can also be avoided by using conditions on  
positions instead (for $a at $pos  in ... where $pos > 10).

So it's your decision...
